? What is a Summons and Complaint?

The Summons, Complaint, and Answer are the documents that begin a lawsuit. These documents present the positions of both the plaintiff and defendant and are required before a lawsuit can proceed. The plaintiff bringing the lawsuit must file a Summons and Complaint to start the lawsuit.

The Defendant has 30 days to respond.

You may still have time to file your Answer if the Plaintiff has not requested that the court enter your default. If in doubt, you should try and file your Answer.

The Answer to Complaint (general denial) that we prepare for you is the first document you will file in your case. It is required to meet the court’s deadline and stop the other side from winning by default, but it is not a good place to tell your side of the story. You will get a chance to tell your side of the story separate from the Answer to Complaint.
